These Terms of Service ("Terms") govern access to and use of services, products, software, and platforms provided by Pushpak AI Private Limited ("Pushpak AI", "Company", "we", "us", or "our").

By accessing or using our services, you agree to these Terms. If you do not agree, you must not use the services.

1. Definitions

For the purposes of these Terms:

Services — All software, applications, platforms, APIs, analytics systems, and solutions provided by Pushpak AI.

Customer — Any organization or individual using Pushpak AI services.

User — Any authorized individual accessing the services through a Customer account.

Content — Data submitted to the platform including images, videos, documents, text, and metadata.

Output — Results generated by Pushpak AI systems including analytics, detections, reports, or insights.

2. Acceptance of Terms

By using Pushpak AI services you confirm that:

  • You have the legal authority to enter into this agreement.
  • You will comply with these Terms.
  • You will comply with all applicable laws and regulations.

If you are using the services on behalf of an organization, you represent that you have authority to bind that organization.

3. Services Provided

Pushpak AI provides AI-powered technologies including but not limited to:

  • Computer Vision and Video Analytics
  • Document Processing and Document AI
  • AI APIs and data processing services
  • Edge AI deployments
  • Enterprise AI platforms
  • Generative AI applications
  • Analytics dashboards and reporting systems

Services may be provided through cloud-based platforms, on-premise installations, edge devices, APIs or SDKs, and custom enterprise deployments.

4. Account Registration

Certain services may require account creation. You agree to:

  • Provide accurate information
  • Maintain account security
  • Notify us of unauthorized access
  • Accept responsibility for activity under your account

Pushpak AI is not liable for losses resulting from unauthorized account access.

5. Acceptable Use

Users agree not to use the services for:

  • Illegal activities
  • Violating privacy laws
  • Surveillance in violation of local regulations
  • Harassment or discrimination
  • Unauthorized access to systems
  • Reverse engineering the platform
  • Uploading malicious software
  • Attempting to disrupt services

Pushpak AI reserves the right to suspend or terminate access for violations.

6. Customer Data

Customers retain ownership of all data submitted to Pushpak AI systems. Customers are responsible for ensuring that they have legal rights to use the data, that data collection complies with applicable laws, and that required consents are obtained where applicable.

Pushpak AI processes customer data solely for the purpose of providing services.

7. AI Processing and Outputs

Pushpak AI systems use machine learning and automated analytics. Users acknowledge that:

  • AI outputs are generated algorithmically
  • Results may not be 100% accurate
  • Outputs should not be relied upon as the sole basis for critical decisions

Pushpak AI shall not be liable for decisions made solely based on AI outputs.

8. Intellectual Property

All intellectual property related to the services — including software, algorithms, AI models, platform design, and documentation — are owned by Pushpak AI or its licensors.

Users are granted a limited, non-exclusive, non-transferable license to use the services. Users may not:

  • Copy or distribute the software
  • Reverse engineer the platform
  • Create derivative works
  • Resell services without authorization

9. Third-Party Services

Pushpak AI services may integrate with third-party providers including cloud platforms, hardware vendors, AI model providers, and external APIs. Pushpak AI is not responsible for the performance or policies of third-party services.

10. Fees and Payments

Certain services may require payment. Customers agree to pay applicable service fees, follow payment terms specified in contracts or invoices, and pay taxes where applicable. Failure to make payments may result in suspension of services.

11. Confidentiality

Both parties agree to protect confidential information including technical information, business strategies, customer data, and system architecture. Confidential information must not be disclosed without prior written consent except where required by law.

12. Data Security

Pushpak AI implements security measures including:

  • Access control mechanisms
  • Encryption protocols
  • Infrastructure monitoring
  • Secure system architecture

However, no system is completely immune from security risks. Users acknowledge that use of the services involves inherent technological risks.

13. Service Availability

Pushpak AI aims to maintain high availability but does not guarantee uninterrupted service. Service interruptions may occur due to maintenance, infrastructure issues, network failures, or third-party service disruptions. Pushpak AI will make reasonable efforts to restore service promptly.

14. Limitation of Liability

To the maximum extent permitted by law, Pushpak AI shall not be liable for:

  • Indirect damages
  • Loss of profits
  • Loss of data
  • Business interruption
  • Consequential damages

Total liability shall not exceed the amount paid by the customer for the services in the preceding 12 months.

15. Indemnification

Customers agree to indemnify and hold Pushpak AI harmless from claims arising from misuse of the services, illegal data collection, violation of third-party rights, or breach of these Terms.

16. Termination

Pushpak AI may suspend or terminate services if Terms are violated, fees remain unpaid, or services are used unlawfully. Customers may terminate service according to contractual agreements.

Upon termination, access to services may be revoked and data may be deleted according to retention policies.

17. Export Compliance

Users must comply with applicable export control laws and regulations. Services must not be used in jurisdictions where such use is restricted by law.

18. Modifications to Services

Pushpak AI reserves the right to update features, modify services, improve AI models, and change system architecture. Such changes may occur without prior notice.

19. Modifications to Terms

Pushpak AI may update these Terms periodically. Updated Terms will be published on our website. Continued use of services after updates constitutes acceptance of the revised Terms.

20. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from these Terms shall fall under the jurisdiction of the courts located in Hyderabad, India.
